Electromagnetic compatibility: Lithuania’s Communications Regulatory Authority (Vilnius) designated as the Union testing facility for EMC for market surveillance — from a call also covering construction products and emissions from non-road mobile machinery; review by 14 April 2030
Commission Implementing Decision (EU) 2025/526, published on 25 March 2025, designates under Article 21(2) of Regulation (EU) 2019/1020 on market surveillance the Communications Regulatory Authority of the Republic of Lithuania (Mortos str. 14, Vilnius) as the Union testing facility for electromagnetic compatibility. Lithuania applied in response to the call for expression of interest CFEI/GRO/IMA/25/2711/14318, assessed in line with the conditions of the call.
- Call and review: the Commission published a call for three categories — construction products, electromagnetic compatibility and pollutant emissions from non-road mobile machinery; the decision concerns EMC only. The designation is subject to review under Article 2 of Implementing Regulation (EU) 2022/1267 by 14 April 2030 and every five years thereafter. The decision entered into force on the twentieth day after publication.
- What a Union testing facility is (Article 21 of Regulation 2019/1020): it is to enhance laboratory capacity and ensure the reliability and consistency of testing for market surveillance in the Union. It must be accredited in accordance with Regulation (EC) No 765/2008 and provides its services exclusively to market surveillance authorities, the Union Product Compliance Network, the Commission and other governmental or intergovernmental entities; the designation does not limit those authorities’ freedom to choose a laboratory.
- Tasks: testing of products at the request of market surveillance authorities, the Network or the Commission; independent technical or scientific advice at the request of the Network; developing new analysis techniques and methods. The activities are remunerated and may be financed by the Union (Article 36(2)), which may also fund increasing testing capacities where they are lacking or insufficient.
- Procedure (Implementing Regulation 2022/1267): public testing facilities of Member States are designated following a call for expression of interest, Commission facilities by direct appointment; product categories and designation conditions are consulted with the Network. The Commission regularly checks whether the facility meets the conditions and the requirements of Article 21(3), (5) and (6), and if not — after consulting the Network — may withdraw the designation.
