Pesticide MRLs: two corrections for the same reason — earlier-adopted regulations overwrote later ones because they started to apply later (flupyradifurone, potassium phosphonate, fenpyrazamine)
Commission Regulation (EU) 2026/751, published on 1 April 2026, and Regulation (EU) 2026/1339, published on 18 June, correct Annex II to Regulation (EC) No 396/2005. In both cases MRLs set later were replaced by values from a regulation adopted earlier but applicable from a later date — the Commission calls this a clerical error in the sequence of dates of application. Both corrections entered into force on the third day after publication.
- Flupyradifurone and potassium phosphonate (2026/751): Regulation (EU) 2025/581, applicable from 17 April 2025, introduced, among other things, Codex MRLs for flupyradifurone in pineapples and sunflower seeds and new MRLs for phosphonic acid in lettuces and salad plants, spinach and similar leaves, watercress, globe artichokes, poppy seeds, barley, oats and rye. These values were, however, replaced by Regulations (EU) 2024/2640 and 2024/2619 — adopted in October 2024 but applicable from 30 and 29 April 2025.
- After the correction the flupyradifurone and phosphonic acid (expressed as phosphonic acid) columns include: pineapples 0.3 and 20 mg/kg, sunflower seeds 0.8 mg/kg flupyradifurone, poppy seeds 200 mg/kg phosphonic acid, barley and oats 3 and 80 mg/kg, rye 1 and 80 mg/kg, lettuces 6 and 200 mg/kg. The annex to Regulation 2025/581 contains the same figures.
- Fenpyrazamine (2026/1339): Regulation (EU) 2019/977, which entered into force on 7 July 2019, transposed Codex MRLs (CXLs) for fenpyrazamine into EU law, but they were replaced by Regulation (EU) 2019/90 — adopted in January 2019 and applicable from 13 August 2019. The error therefore lasted almost seven years. The corrected column includes tomatoes, sweet peppers and aubergines 3 mg/kg, sweet cherries 4 mg/kg and lettuces 8 mg/kg — as in 2019/977.
- For laboratories assessing sample compliance with MRLs this signals that a value in a database or evaluation spreadsheet may come from the overwritten regulation: the corrections apply from 4 April 2026 (flupyradifurone, phosphonic acid) and from 21 June 2026 (fenpyrazamine). Fenpyrazamine is marked (F) in the annex — fat-soluble.
