Microplastics under REACH: an exemption for research and a stricter solid matrix condition
Regulation (EU) 2026/1168 amends entry 78 of Annex XVII to REACH, the restriction on synthetic polymer microparticles.
- A new exemption covers product and process orientated research and development up to one tonne per year and applies from 17 October 2023.
- The exemption for medicinal products now also covers clinical trials and preclinical testing, likewise from 17 October 2023.
- Microparticles permanently incorporated into a solid matrix are exempt only where the intended end use lasts one year or longer; this condition applies from 22 June 2028.
- A laboratory working on its own research samples at that scale now falls under the research and development exemption.
